Terms of Service

Welcome to Kwibal. These Terms of Service ("Terms") are an agreement between you and Kwibal ("Kwibal", "we", "us") and govern your use of https://kwibal.com and the services offered through it (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What Kwibal Is
Kwibal is a local secondhand marketplace with delivery. You search items available near you, buy at the listed price or make an offer, and — once a Kwibal employee has verified your order — a driver picks the item up and delivers it to your door. Items are pre-owned unless stated otherwise.
2. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Service. Browsing and searching are open to everyone; ordering requires an account and a delivery address within a supported service area. You are responsible for your account credentials and for activity under your account. Keep your delivery details accurate — deliveries go to the address on file at the time of the order.
3. Orders, Holds, and Charges
When you place an order or make an offer, we place an authorization hold on your card for the total (item price plus delivery). A hold is not a charge: no money moves when you order.
Your card is charged only after a Kwibal employee verifies that the item is genuine, matches its listing, and is still available. If we decline the order, the item is no longer available, the hold expires, or you cancel first, the hold is released and you pay nothing. Card authorization holds are subject to your card issuer's rules and typically expire after about seven days if not captured.
4. Offers
You may offer less than the listed price. The chance-of-success estimate shown with an offer is exactly that — an estimate, not a promise that the offer will be accepted. An accepted offer proceeds like any other order: verification first, then charge, then delivery. Offers you withdraw before resolution release their hold.
5. Delivery
Delivery cost is calculated from the actual driving distance to your address and shown before you commit. Delivery timing shown on the Service (often same-day or next-day) is an estimate, not a guarantee; actual timing depends on driver availability, distance, and conditions. Someone should be available to receive the item, or you may designate a safe drop location. Responsibility for the item passes to you on delivery.
6. Cancellations
You can withdraw any order that has not been finalized from your orders page; the hold on your card is released when you do. Once an order is finalized and charged, it can no longer be cancelled through the Service — contact us and we will do our best to help.
7. Items and Condition
Everything on Kwibal is secondhand and sold in as-is condition as described in its listing. We verify orders before charging you, but pre-owned items naturally show wear. If your item arrives materially different from its listing or damaged in delivery, contact us within 48 hours of delivery at info@kwibal.com; remedies may include redelivery, a credit, or a refund, determined case by case.
8. Pricing and Availability
Listings are time-limited and availability changes quickly. We may correct pricing or listing errors, and we may cancel (and release the hold for) any order affected by an error. Nothing on the Service is an offer to sell until we finalize your order.
9. Acceptable Use
Don't misuse the Service. That includes: attempting to bypass payment or verification; scraping or bulk-harvesting content; submitting false forms or fraudulent payment methods; interfering with the Service's operation or security; or using the Service for anything unlawful. We may suspend or terminate accounts that violate these Terms.
10. Communications
We send transactional email about your account and orders. If you join the early-access waitlist you agree to receive launch-related email, which you can opt out of at any time. See our Privacy Policy for how we handle your information.
11. Intellectual Property
The Service — its design, software, text, and branding, including the KWIBAL name and logo — belongs to Kwibal or its licensors. We grant you a limited, revocable, non-exclusive license to use the Service for its intended purpose. KWIBAL is a registered trademark.
12. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in these Terms (including section 7's remedy process).
13. Limitation of Liability
To the fullest extent permitted by law, Kwibal's total liability for any claim arising out of the Service is limited to the greater of (a) the amounts you paid to Kwibal in the twelve months before the claim and (b) one hundred dollars ($100). We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, contact us at info@kwibal.com — most concerns can be resolved informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.
15. Changes and Termination
We may update these Terms as the Service evolves; we will post the revised Terms here with an updated date, and material changes will be notified reasonably in advance. Continued use after changes take effect means you accept them. You may stop using the Service at any time; we may suspend or terminate access for violations of these Terms. Sections that by their nature should survive termination (including 11–14) do.
