Terms of Service

Welcome to Kwibal. These Terms of Service ("Terms") are an agreement between you and Kwibal ("Kwibal", "we", "us") and govern your use of https://kwibal.com and the services offered through it (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What Kwibal Is

Kwibal is a local secondhand marketplace with delivery. You search items listed near you, buy at the listed price or make an offer, and — once a Kwibal team member confirms that the order can proceed — Kwibal coordinates pickup and delivery. Items are pre-owned unless stated otherwise.

2. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service. Nearby browsing and the Free Pile are open without an account. If you are not signed in, your browser may start one keyword-search journey and continue that same search by changing filters, retrying, or loading more results. Starting a different keyword search requires you to sign in or create an account. We remember the available search journey with a cookie in that browser. Because browser cookies can be cleared, this is a browser-level limit, not a per-person identity check. Ordering requires an account and a delivery address within a supported service area. You are responsible for your account credentials and for activity under your account. Before placing an order or offer, you must verify your email and provide the name, phone number, and delivery address Kwibal needs to coordinate delivery. Keep those details accurate — deliveries go to the address on file at the time of the order.

3. Orders, Holds, and Charges

When you place an order or make an offer, we request an authorization hold for the total shown at checkout: the item or offer price, delivery charge, Kwibal fee, and payment-processing fee. An authorization is not a completed charge, but it may temporarily reduce your available funds or credit.

Payment is captured only after Kwibal confirms availability and that the order can proceed. If we decline the order, the authorization expires, or you cancel before finalization, Kwibal initiates release of the hold. Your card issuer controls when a released hold disappears from your account. The authorization deadline depends on the card network and is recorded for your order.

4. Offers

You may offer less than the listed price. The chance-of-success estimate shown with an offer is exactly that — an estimate, not a promise that the offer will be accepted. An accepted offer proceeds like any other order: confirmation first, then payment capture and delivery. If you withdraw an unresolved offer, Kwibal initiates release of its hold.

5. Delivery

Delivery cost is calculated for the item and your saved address and shown before you commit. Delivery timing is coordinated after order confirmation and depends on route conditions, availability, and scheduling. Someone should be available to receive the item. Responsibility for the item passes to you on delivery.

6. Cancellations

You can withdraw any order that has not been finalized from your orders page; Kwibal initiates release of the card hold when you do. Your issuer controls how quickly the hold disappears. Once an order is finalized and charged, it can no longer be cancelled through the Service — contact us and we will do our best to help.

7. Items and Condition

Everything on Kwibal is secondhand and sold in as-is condition as described in its listing. Order confirmation does not guarantee authenticity or a specific condition beyond what the listing states, and pre-owned items naturally show wear. If your item is not received, is the wrong item, has missing parts, arrives materially different from its listing, or appears to have been damaged during delivery, submit an issue case from the order page within 48 hours after delivery is recorded. Opening a case starts a review; it does not by itself determine an outcome or change the charge. We may ask for more information and will explain any remedy available for that order. If you cannot access the order page, contact info@kwibal.com within the same 48-hour window.

8. Pricing and Availability

Listings are time-limited and availability changes quickly. We may correct pricing or listing errors, and we may cancel (and initiate release of the hold for) any order affected by an error. Nothing on the Service is an offer to sell until we finalize your order.

9. Acceptable Use

Don't misuse the Service. That includes: attempting to bypass payment or confirmation; scraping or bulk-harvesting content; submitting false forms or fraudulent payment methods; interfering with the Service's operation or security; or using the Service for anything unlawful. We may suspend or terminate accounts that violate these Terms.

10. Communications

We send transactional email about your account and orders. If you enable a saved-search alert, you ask us to email you about newly found matches and can turn that alert off from your account. Optional updates include a way to opt out. See our Privacy Policy for how we handle your information.

11. Intellectual Property

The Service — its design, software, text, and branding, including the KWIBAL name and logo — belongs to Kwibal or its licensors. We grant you a limited, revocable, non-exclusive license to use the Service for its intended purpose. KWIBAL is a registered trademark.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, except as expressly stated in these Terms.

13. Limitation of Liability

To the fullest extent permitted by law, Kwibal's total liability for any claim arising out of the Service is limited to the greater of (a) the amounts you paid to Kwibal in the twelve months before the claim and (b) one hundred dollars ($100). We are not liable for indirect, incidental, special, or consequential damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Before filing any claim, contact us at info@kwibal.com — most concerns can be resolved informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Orange County, California, and you consent to their jurisdiction.

15. Changes and Termination

We may update these Terms as the Service evolves; we will post the revised Terms here with an updated date, and material changes will be notified reasonably in advance. Continued use after changes take effect means you accept them. You may stop using the Service at any time; we may suspend or terminate access for violations of these Terms. Sections that by their nature should survive termination (including 11–14) do.
